1. Acceptance of Terms

By accessing or using the montclair.ai website and community platform (the "Service"), operated by Montclair.ai ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Montclair.ai is a community platform for Montclair, NJ residents and neighbors to explore artificial intelligence, attend and host meetups, and access community AI tools. The Service includes:

  • User accounts and profiles
  • A meetup directory for browsing, hosting, and attending community events
  • AI-powered township tools (currently in development)
  • Community newsletter and communications

3. Eligibility

You must be at least 13 years of age to use the Service. By creating an account, you represent that you are at least 13 years old and that the information you provide is accurate and complete.

4. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must provide accurate and current information when creating your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

5. Community Conduct

Montclair.ai is a community-centered platform. By using the Service, you agree to:

  • Treat all community members with respect and courtesy
  • Not post or share content that is defamatory, harassing, threatening, obscene, or otherwise objectionable
  • Not use the Service for any illegal purpose or in violation of any applicable law
  • Not impersonate any person or entity or misrepresent your affiliation
  • Not attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems
  • Not use the Service to distribute spam, malware, or unsolicited commercial communications
  • Not scrape, crawl, or use automated means to access the Service without our written consent

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines, at our sole discretion and without prior notice.

6. Meetups and Events

6.1 Hosting Meetups

  • All meetups are subject to approval by our administrators before they appear publicly.
  • As a host, you are responsible for the accuracy of your meetup details (title, description, location, date, time, capacity).
  • You are responsible for the safe and lawful conduct of events you host.
  • Montclair.ai does not organize, sponsor, or supervise user-hosted meetups unless explicitly stated.

6.2 Attending Meetups

  • Attendance at meetups is at your own risk.
  • Montclair.ai is not responsible for the conduct of hosts or other attendees.
  • You should exercise your own judgment regarding personal safety when attending any event listed on the platform.

7. AI Tools

AI-powered tools offered through the Service are provided for informational and convenience purposes only. They are not a substitute for professional advice, official township communications, or authoritative government sources. AI-generated responses may contain errors or outdated information.

We make no warranties regarding the accuracy, completeness, or reliability of AI tool outputs. You should independently verify any information obtained through AI tools before relying on it.

8. User Content

"User Content" means any information, text, or other material you submit to the Service (including meetup descriptions, profile information, and other contributions).

  • You retain ownership of your User Content.
  • By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your User Content in connection with operating and promoting the Service.
  • You represent that you have the right to submit any User Content you provide and that it does not infringe on any third party's rights.
  • We may remove User Content that violates these Terms or is otherwise objectionable.

9. Intellectual Property

The Service, including its design, branding, code, and original content (excluding User Content), is owned by Montclair.ai and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

10. Third-Party Services

The Service integrates with or links to third-party services including Supabase, Vercel, Google, and Substack. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONTCLAIR.AI AND ITS OPERATORS, VOLUNTEERS, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless Montclair.ai, its operators, volunteers, and contributors from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) shall survive.

You may delete your account at any time. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Essex County, New Jersey.

16. Changes to These Terms

We may revise these Terms at any time by updating this page. Material changes will be indicated by updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
